General trading conditions
of the companie called "Cancun Fashion”,

1. The following conditions apply for all contracts, shipments and other services.

We strictly disagree to different regulations of the party to the contract. All other agreements must be confirmed in writing by us.

2. Validity

Our offers are non-binding. Small divergences and technical changes to our photos or descriptions can occur. Cancun Fashion does not accept any responsibility for possible printing faults and mistakes. The respective internet catalogue loses its validity as soon as there is a new edition.

3. Right of return / explanation

Cancun Fashion grant an unlimited right of two weeks after receipt of the goods according to the regulations of legitimate distant sales.We will refund the whole buying price or another article if requested. In order to meet the deadline simply send back the goods on time. The customer is obliged to return the goods (§ 357 II BGB).

4. Payment

Shipment is carried out COD or payment with credit card. Other payment possibilities is cash in advance by transfer to our account.

5. Note: legal consequences if the goods worsen/decline

If the goods were used or damaged according to size and pleasure – over examination of the object – Cancun Fashion expressively reserves the right to replacement of the value (§§ 357 III BGB). This can be avoided if labels and stickers have not been removed and if the clothes are simply examined for size and pleasure and returned if carefully packed and being disliked.

6. VAT

All prices include 16 % VAT.

7. Part shipment

We reserve the right for part shipments as long as thes has a positive influence on a prompt execution.

8. Non acceptance, refusal, non collection

If not agreed upon otherwise, we will charge the customer the resulted costs if the goods not accepted, refused or not collected, we will charge the customer the resulting costs plus handling charge. These costs are calculated from the double shipping costs of the respective shipments plus a handling charge of ¤ 10,00. The same applies to merchandise that could not be delivered due to wrong address indication of the customer.

9. Liability

Cancun Fashion do not take any liability for possible damages, occuring by using the sold products, especially by improper use.

10. Guarantee

The guarantee period is two years and applies to faults of the merchandise, i.e. divergence of the actual nature of the merchandise from the one promised by contract (fault in material and production). The article is to be sent back along with the invoice. For this case, Cancun Fashion reserves the right to deliver an identic, perfect replacement article against refund of the faulty one. If a new delivery is not possible, the customer has the particular right to minimize the purchasing price or to withdraw from the contract. If he does so, he will be refunded the full purchasing prize. If it is the customer’s expressive wish he can chose an article of the same value as replacement at Cancun Fashion.

11. Reservation of prorietary rights

Until the goods are fully paid they remain the propberty of Cancun Fashion.

12. Data Safety

According to § 28 of the Federal Data Safety Law, we draw your attention to the fact that the datas necessary for the business deal are used and safed with the help of a computer system. We will of course treat all personal datas confidentially. Customer datas will be used and safed by considering the relevant regulations of the Federal Data Safety Laws as well as of the TDDSG. Your personal datas will only be passed on for fixed, clear and legal purposes and will not be kept longer than necessary. 13. Copyright

All sites of www.cancun-fashion.com are subject to copyright. The use of graphics, texts, picures etc. is only allowed with written approval of Cancun Fashion.

14. Court of jurisdiction

The court of jurisdiction is Freiburg i. B./ Germany. The law of the Federal Republic of Germany is exclusively valid.

15. Final regulation

If some of the above regulations are or will be invalid, the validity of the remaining regulations are not influenced.
